concerning the extension of the action taken by the Ministry of Health of the Czech Republic permitting the making available on the market and use of the biocidal product Tandem in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 55(1), third subparagraph, thereof,
Whereas:
(1) On 5 August 2024, the Ministry of Health of the Czech Republic (‘the competent authority of Czechia’) adopted, in accordance with Article 55(1), first subparagraph, of Regulation (EU) No 528/2012, a decision to permit, from 1 October 2024 until 30 March 2025 the making available on the market and use by trained professionals of the biocidal product Tandem for the control of bed bugs infestation in the dormitories of the Service Facilities Administration CTU Strahov (‘the action’). The competent authority of Czechia informed the Commission and the competent authorities of the other Member States of the action and the justification for it, in accordance with Article 55(1), second subparagraph, of that Regulation.
(2) According to the information provided by the competent authority of Czechia, the action was necessary in order to protect public health. The use of the biocidal product Tandem was needed to control the severe bed bug infestation in the dormitories of the Service Facilities Administration CTU Strahov. Bed bugs can cause various dermatological problems, including severe allergic reactions, and, according to the competent authority of Czechia, a severe bed bugs infestation can even cause mental health problems. Moreover, the competent authority of Czechia informed that the infestation needs to be controlled to prevent the spreading of bed bugs outside the dormitories of Service Facilities Administration CTU Strahov, caused by students moving around with their belongings, which could possibly be infested.
(3) According to the competent authority of Czechia, the use of biocidal products available on the market in Czechia has proven ineffective to control the bed bug infestation present in the dormitories of Service Facilities Administration CTU Strahov for several years. Given the severity of the infestation reached in 2024, the use of an alternative product was necessary. The use of Tandem has proven effective in reducing the severity of the infestation.
(4) The biocidal product Tandem is a biocidal product of product-type 18 (insecticides, acaricides and products to control other arthropods), as defined in Annex V to Regulation (EU) No 528/2012. Tandem contains thiamethoxam and lambda-cyhalothrin as active substances and is intended for use by trained professionals only. The approval of thiamethoxam expired on 31 January 2025 for use in biocidal products of product-type 18, while lambda-cyhalothrin is approved for use in biocidal products of product-type 18. Tandem has not been authorised in Czechia. In accordance with the temporary permit granted by the competent authority of Czechia, Tandem can be used only by a specific company (EKOSAN servis s.r.o.) and only on the premises of the dormitories of Service Facilities Administration CTU Strahov.
(5) On 10 January 2025, the Commission received a reasoned request from the competent authority of Czechia to allow the extension of the action in accordance with Article 55(1), third subparagraph, of Regulation (EU) No 528/2012. The reasoned request included the same information provided already when the action was taken and was based on concerns that the discontinued use of Tandem, in a situation where the bed bugs infestation has not yet been fully eradicated, would constitute a threat to public health, given that the health of the students might be endangered and the spread of the bed bugs outside the premises of the dormitories might occur. The Commission analysed the information included in the reasoned request.
(6) The lack of proper control of the bed bugs infestation in the dormitories of Service Facilities Administration CTU Strahov might endanger public health and that danger cannot be adequately contained by using another biocidal product or by other means. It is therefore appropriate to allow the competent authority of Czechia to extend the action for a period of 550 days.
(7) As the action expired on 30 March 2025, this Decision should apply retroactively.
(8) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products,
HAS ADOPTED THIS DECISION:
Article 1
The Ministry of Health of the Czech Republic may extend until 2 October 2026 the action permitting the making available on the market and use of the biocidal product Tandem for the control of the bed bugs infestation in the dormitories of Service Facilities Administration CTU Strahov, provided that it ensures that the product is only used by the operator determined in the temporary permit, by trained professionals and within the determined premises.
Article 2
This Decision is addressed to the Ministry of Health of the Czech Republic.
It shall apply from 31 March 2025.
