DECISION OF THE EEA JOINT COMMITTEE No 221/2024

amending Annex XVIII (Health and safety at work, labour law, and equal treatment for men and women) to the EEA Agreement [2024/3049]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Directive (EU) 2019/1152 of the European Parliament and of the Council of 20 June 2019 on transparent and predictable working conditions in the European Union ( 1 ) is to be incorporated into the EEA Agreement.

(2) Directive (EU) 2019/1152 repeals, with effect from 1 August 2022, Council Directive 91/533/EEC ( 2 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 1 August 2022.

(3) Annex XVIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The text of point 25 (Council Directive 91/533/EEC) of Annex XVIII to the EEA Agreement shall be replaced by the following with effect from 1 August 2022:

‘ 32019 L 1152 : Directive (EU) 2019/1152 of the European Parliament and of the Council of 20 June 2019 on transparent and predictable working conditions in the European Union ( OJ L 186, 11.7.2019, p. 105 ).

The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:

In Article 1(2), the words “and of the EFTA Court, in accordance with the EEA Agreement” shall be added after the words “the Court of Justice”.’

Article 2

The text of Directive (EU) 2019/1152 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 24 September 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
