DECISION OF THE EEA JOINT COMMITTEE No 15/2024

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1555]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2023/2089 of 28 September 2023 approving reaction mass of N,N-didecyl-N-(2-hydroxyethyl)-N-methylammonium propionate and N,N-didecyl-N-(2-(2-hydroxyethoxy)ethyl)-N-methylammonium propionate and N,N-didecyl-N-(2-(2-(2-hydroxyethoxy)ethoxy)ethyl)-N-methylammonium propionate as an active substance for use in biocidal products of product-types 2 and 4 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2023/2100 of 28 September 2023 postponing the expiry date of the approval of copper (II) oxide for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2023/2101 of 28 September 2023 postponing the expiry date of the approval of sulfuryl fluoride for use in biocidal products of product-types 8 and 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Decision (EU) 2023/2377 of 28 September 2023 not approving silver copper zeolite as an existing active substance for use in biocidal products of product-type 4 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Decision (EU) 2023/2378 of 28 September 2023 postponing the expiry date of the approval of alphachloralose for use in biocidal products of product-type 14 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 5 ) is to be incorporated into the EEA Agreement.

(6) Commission Implementing Decision (EU) 2023/2380 of 28 September 2023 postponing the expiry date of the approval of basic copper carbonate for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 6 ) is to be incorporated into the EEA Agreement.

(7) Commission Implementing Decision (EU) 2023/2386 of 29 September 2023 postponing the expiry date of the approval of copper hydroxide for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 7 ) is to be incorporated into the EEA Agreement.

(8) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 12zzzzzzzzzn (Commission Implementing Decision (EU) 2023/471) of Chapter XV of Annex II to the EEA Agreement:

Article 2

The texts of Implementing Regulation (EU) 2023/2089 and Implementing Decisions (EU) 2023/2100, (EU) 2023/2101, (EU) 2023/2377, (EU) 2023/2378, (EU) 2023/2380 and (EU) 2023/2386 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 3 February 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
